Terms and Conditions

§ 1 Scope, Customer Information

The following general terms and conditions govern the contractual relationship between Jacobi Decor GmbH Cake Company and consumers and entrepreneurs purchasing goods through our shop. Contrary or deviating conditions from our terms and conditions are not recognised by us. The contract language is German.

§ 2 Conclusion of Contract

The online offers are non-binding invitations for you to purchase goods.
After entering your data and clicking the order button, you submit a binding offer to conclude a purchase contract. You can also place a binding order by telephone or fax. The confirmation of receipt of your order sent immediately by email or fax does not constitute acceptance of the purchase offer.
We are entitled to accept your offer within 2 days by sending an order confirmation via email. If the period mentioned in sentence 1 expires without success, your offer is deemed rejected, meaning you are no longer bound by your offer. For telephone orders, the purchase contract is concluded if we accept your offer immediately. If the offer is not accepted immediately, you are no longer bound by it.

§ 3 Customer Information: Storage of Your Order Data

Your order details and the concluded contract (e.g., type of product, price, etc.) are stored by us. We send you the terms and conditions, but you can also access them at any time after the contract is concluded via our website.

As a registered customer, you can access your past orders through the customer login area (your account).

§ 4 Customer Information: Correction Notice

You can correct your entries at any time before submitting the order using the delete key. We inform you during the ordering process about further correction options. You can also terminate the entire ordering process at any time by closing the browser window.

§ 5 Retention of Title

The purchased item remains our property until full payment is made.

§ 6 Limitation Period for Your Warranty Claims

Warranty for Consumers on Used Goods
Our goods are subject to statutory defect liability rights.

Your claims for defects in used items expire one year after the transfer of the sold item to you. This regulation does not apply to claims for damages, claims due to defects we have fraudulently concealed, and claims from a warranty we have assumed for the condition of the item. The statutory limitation periods apply to these excluded claims.
Warranty for Entrepreneurs
Our goods are subject to statutory defect liability rights.

Your warranty claims for defects in the purchased item expire one year after the transfer of risk. This regulation does not apply to claims for damages, claims due to defects we have fraudulently concealed, and claims from a warranty we have assumed for the condition of the item. The statutory limitation periods also apply to the recourse claim according to § 478 BGB. The statutory limitation periods apply to these excluded claims.

§ 7 Limitation of Liability

We exclude liability for slightly negligent breaches of duty, provided they do not concern essential contractual obligations, damages resulting from injury to life, body, or health, guarantees, or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and legal representatives. Essential contractual obligations include in particular the obligation to deliver the item to you and transfer ownership. Furthermore, we are obliged to deliver the item free from material and legal defects.

§ 8 Jurisdiction

The exclusive place of jurisdiction for all disputes arising from this contract is our business location if you are a merchant.
